一、不能认定为企业业绩的工程 I. Projects that cannot be identified as corporate performance

根据《建筑业企业资质管理规定和资质标准实施意见》规定: According to the Regulations on the Management of Qualifications of Construction Enterprises and the Implementation of Qualification Standards:

、单位工程未竣工验收或验收不合格,不能作为申请建筑工程施工总承包资质的业绩考核。 1. The uncompleted acceptance or unacceptable acceptance of a unit project cannot be used as a performance appraisal for applying for general contracting qualification of construction projects.

二、设计、图纸出问题 2. Design and drawing problems

、工程立面图纸不清晰,且未能反映项目为单体建筑。 2. The drawing of the project elevation is not clear and fails to reflect that the project is a single building.

、项目图纸无设计单位出图章、设计人员注册执业印章。 3. The project drawing has no stamp issued by the design unit, and the designer's registered practice seal.

、工程提供图纸未能反映考核指标。 4. The drawings provided by the project failed to reflect the assessment indicators.

五、人员、设备出问题 V. Problems with personnel and equipment

、机械设备不达标。 2. Mechanical equipment is not up to standard.

、提供的设备购置发票不清晰,未能反映设备名称及技术指标,不予认定。 3. The equipment purchase invoice provided is unclear, fails to reflect the equipment name and technical indicators, and will not be identified.

业绩核查,谁负责? Performance verification, who is responsible?

、企业对填报信息的真实性和完整性负责,不得弄虚作假。 1. The enterprise is responsible for the authenticity and completeness of the information submitted, and must not falsify.

业绩造假,怎么处罚? Fake performance, how to punish?

根据《建设工程企业资质申报弄虚作假行为处理办法》(建市 [2011]200 号)的规定: According to the provisions of the Measures for the Treatment of Fraudulent Acts in the Declaration of Qualifications of Construction Engineering Enterprises (Jianshi [2011] No. 200 ):

、对资质申报中弄虚作假的企业,住房城乡建设主管部门依法给予警告,并作如下处理: 1. For the fraudulent enterprises in the qualification declaration, the competent department of housing urban and rural construction shall give a warning in accordance with the law and deal with it as follows:

(一)企业新申请资质时弄虚作假的,不批准其资质申请,企业在一年内不得再次申请该项资质; (1) If an enterprise falsifies when applying for new qualifications, its qualification application will not be approved, and the enterprise shall not apply for the qualification again within one year;

(二)企业在资质升级、增项申请中弄虚作假的,不批准其资质申请,企业在一年内不得再次申请该项资质升级、增项; (2) If the enterprise falsifies the application for qualification upgrade or addition, the application for qualification shall not be approved, and the enterprise shall not apply for the upgrade or addition of such qualification within one year;

(三)企业在资质延续申请中弄虚作假的,不予延续;企业按低一等级资质或缩小原资质范围重新申请核定资质,并一年内不得申请该项资质升级、增项。 (3) If the enterprise cheats in the application for renewal of qualifications, it shall not be renewed; the enterprise shall reapply for approval of qualifications based on the lower-level qualifications or narrow the scope of the original qualifications, and shall not apply for the qualification upgrade or addition within one year.

、对弄虚作假取得资质的企业,住房城乡建设主管部门依法给予行政处罚并撤销其相应资质,且自撤销资质之日起三年内不得申请该项资质。 2. For enterprises that have obtained qualifications through fraud, the competent department of housing and urban-rural construction shall give administrative penalties and revoke their corresponding qualifications according to law, and shall not apply for such qualifications within three years from the date of revocation.

近年来,部分建筑业企业弄虚作假,提供虚假业绩材料,骗取资质的现象较多,严重干扰了正常的资质审查工作。 In recent years, some construction companies cheated, provided false performance materials, and deceived their qualifications more frequently, which seriously interfered with the normal qualification review. 为做好建筑业企业资质审查工作,我司决定对 2016 11 1 日前申请建筑工程、市政公用工程施工总承包特级、一级资质的企业开展业绩核查,现将有关事项通知如下: In order to do a good job in the qualification review of construction enterprises, our company has decided to carry out performance verification on enterprises applying for super-class and first-class qualifications in general contracting for construction engineering, municipal public works construction before November 1 , 2016. 一、企业申报的业绩信息在住房城乡建设部网站(网址: www.mohurd.gov.cn )公示,接受社会监督。 1. The performance information declared by the enterprise is publicized on the website of the Ministry of Housing, Urban and Rural Construction (website: www.mohurd.gov.cn ), and it is subject to social supervision.

二、请各省级住房城乡建设主管部门对本地区企业的申报业绩开展业绩核查,具体要求另行通知。 2. Provincial competent housing and urban-rural construction authorities are requested to conduct performance verification on the reported performance of enterprises in the region, and specific requirements will be notified separately.

三、对省级住房城乡建设主管部门出具的业绩核查结果,我司将组织抽查。 3. 四、业绩核查或审查中发现资质申报存在弄虚作假行为的企业,我司将按照《建设工程企业资质申报弄虚作假行为处理办法》(建市 [2011]200 号)严肃处理,对其申请事项不予行政许可,一年内不受理该项行政许可,并在我部网站予以通报,记入不良行为信用档案并向社会公布。 4. 建设工程企业资质申报弄虚作假行为处理办法 Measures for Dealing with Fraudulent Activities in the Qualification Declaration of Construction Engineering Enterprises

建市 [2011]200 Jianshi [2011] No. 200

第一条为建立和维护公平竞争、规范有序的建筑市场秩序,加强建筑市场的准入清出管理,严肃查处建设工程企业资质申报中弄虚作假行为,依据《中华人民共和国建筑法》、《中华人民共和国行政许可法》等法律法规,制定本办法。 Article 1 In order to establish and maintain a fair competition, regulate the order of the construction market, strengthen the management of access to the construction market, and seriously investigate and deal with fraudulent acts in the qualification declaration of construction engineering enterprises. The People's Republic of China's Administrative Licensing Law and other laws and regulations have formulated these Measures.

第五条各级住房城乡建设主管部门应当依法按照行政审批权限,对涉嫌在资质申报中弄虚作假企业进行核查处理,不在行政审批权限范围内的,应当及时将相关情况逐级上报至有权限的住房城乡建设主管部门研究处理。 Article 5 Departments of housing and urban-rural construction at all levels shall, in accordance with the law and in accordance with the administrative approval authority, verify and handle suspected fraudulent enterprises in the qualification declaration. 第六条住房和城乡建设部可委托省级住房城乡建设主管部门对涉嫌在资质申报中弄虚作假的企业进行核查。 Article 6 The Ministry of Housing and Urban-Rural Development may entrust the provincial-level housing and urban-rural construction authorities to conduct inspections on enterprises suspected of fraud in the qualification declaration. 受委托部门应在规定时限内将核查的有关情况、原始材料和处理建议上报。 The entrusted department shall report the relevant information, original materials and treatment suggestions for verification within the prescribed time limit.

第七条省级住房城乡建设主管部门应当每半年将资质申报中对弄虚作假行为的处理结果汇总上报住房和城乡建设部备案。 Article 7 The competent department of urban and rural construction of housing at the provincial level shall report the results of the fraudulent acts in the qualification declaration to the Ministry of Housing and Urban-Rural Development for the record every six months.

第八条任何单位和个人有权向住房城乡建设主管部门举报企业在申报资质中弄虚作假的行为。 Article 8 Any unit or individual has the right to report to the competent department of housing, urban and rural construction the fraudulent acts of enterprises in applying for qualifications. 对能提供基本事实线索或相关证明材料的举报,住房城乡建设主管部门应予受理,并为举报单位或个人保密。 For reports that can provide clues to basic facts or relevant proof materials, the competent department of housing urban and rural construction shall accept the report and keep it confidential for the reporting unit or individual.

第九条住房城乡建设主管部门之间应当建立资质申报中弄虚作假行为的协查机制。 Article 9 The administrative department of housing and urban-rural construction shall establish a co-investigation mechanism for fraudulent acts in qualification declaration. 协助核查的主管部门应当予以配合,并在规定时限内书面反馈核查情况。 The competent department assisting the inspection shall cooperate and provide written feedback on the inspection within the prescribed time limit.

第十条住房城乡建设主管部门应在 20 个工作日内完成对涉嫌申报资质中弄虚作假企业的核查,可要求被核查企业提供相关材料;核查期间,暂不予做出该申报行政许可决定,核查时间不计入审批时限。 Article 10 The competent department of housing and urban-rural construction shall complete the verification of the suspected fraudulent enterprise in the declared qualification within 20 working days, and may require the verified enterprise to provide relevant materials; during the verification period, the decision of the administrative license for the declaration shall not be made for the time being. 第十一条因涉嫌在资质申报过程中弄虚作假被核查的企业,应积极配合相关部门核查。 Article 11 An enterprise that has been checked for suspected fraud in the qualification declaration process shall actively cooperate with relevant departments for checking.

第十二条对资质申报中弄虚作假的企业,住房城乡建设主管部门按照行政审批权限依法给予警告,并作如下处理: Article 12 For enterprises that have been deceived in the declaration of qualifications, the competent department of housing urban and rural construction shall give a warning in accordance with the administrative examination and approval authority and shall deal with it as follows:

第十六条对参与企业资质申报弄虚作假或为企业提供虚假证明的有关单位或个人,住房城乡建设主管部门给予通报批评或抄报有关部门依法进行处理。 Article 16 The competent department of housing, urban and rural construction shall report or criticize the relevant units or individuals involved in the fraudulent declaration of the enterprise's qualifications or provide false certificates to the enterprise or deal with them in accordance with the law.

第十七条对参与企业资质申报弄虚作假的住房城乡建设主管部门及其工作人员,依法由其上级行政机关或者监察机关责令改正,对直接负责的主管人员和其他直接责任人员依法给予行政处分。 Article 17 The administrative departments of housing and urban and rural construction and their staff who have falsified the qualification declaration of participating enterprises shall be ordered to make corrections by their superior administrative organs or supervisory organs according to law, and the directly responsible supervisors and other directly responsible persons shall be given administrative sanctions in accordance with law.

第十八条住房城乡建设主管部门将企业资质申报中的弄虚作假行为作为企业或个人不良行为在全国诚信信息平台予以发布。 Article 18 The competent department of housing urban and rural construction shall publish fraudulent acts in the enterprise qualification declaration as corporate or individual bad behaviors on the national integrity information platform.

第十九条本办法自发布之日起施行,原《对工程勘察、设计、施工、监理和招标代理企业资质申报中弄虚作假行为的处理办法》(建市 [2002]40 号)同时废止。 Article 19 These Measures shall be implemented as of the date of promulgation, and the original "Handling Measures for Fraudulent Acts in Engineering Survey, Design, Construction, Supervision, and Tendering Agency Qualification Declaration" (Jianshi [2002] No. 40 ) shall be abolished at the same time.
